Former New York Gov. Mario M. Cuomo has been appointed by the judge overseeing trustee Irving Picard's lawsuit against Fred and Jeff Wilpon and Saul Katz as a mediator.

ORDER DIRECTING MEDIATION
WHEREAS, on December 7, 2010, Irving H. Picard, Trustee for the Substantively Consolidated SIPA Liquidation of Bernard L. Madoff Investment Securities LLC and Bernard L. Madoff (the “Trustee”) filed a complaint in the above-referenced adversary proceeding (the “Adversary Proceeding”) (Dkt. No. 1), and WHEREAS, the Court determines that there are special issues presented in the Adversary Proceeding that suggest referral to an appropriately experienced mediator, and WHEREAS, the parties have been informed of and consented to the Court’s choice of mediator, it is hereby ORDERED, that the issues presented in the Adversary Proceeding be assigned to mediation pursuant to the Court’s General Order Amending and Restating Adopting Procedures Governing Mediation of Matters in Bankruptcy Cases and Adversary Proceedings, dated December 1, 2009, and any amendments thereto (the “General Order”); and it is further ORDERED, that Governor Mario M. Cuomo (the “Mediator”) is appointed to serve as the Mediator for the parties in accordance with the General Order; and it is further ORDERED, that no documents relating to the matter to be mediated shall be filed with the Court.
